Navy Federal Credit Union TCPA

On March 23, 2020, Judge Leonie M. Brinkema of the U.S. District Court for the Eastern District of Virginia granted preliminary approval to a nationwide class action settlement negotiated by Goldenberg Schneider and its co-counsel in Hawkins v. Navy Federal Credit Union, E.D. Va. 1:19-cv-01186. This case arose from nonconsensual, autodialed wrong-number text messages Defendant Navy Federal Credit Union (“NFCU”) allegedly sent to the cellphone numbers of thousands of noncustomers, which plaintiff alleged violated the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227(b). The proposed Settlement calls for NFCU to pay $9,250,000 into a nonreversionary common fund for the benefit of a Settlement Class comprised of all nonmembers of NFCU who received nonfraud-related text messages from NFCU on their cellular telephones since September 15, 2015. Under the settlement, no money will revert to NFCU.

The court set a fairness hearing for October 9, 2020. If granted final approval, the settlement will successfully resolve claims for the approximately 66,000 class members. The deadline to submit a claim form is September 7, 2020.
