Parker V. Berkley Premium Nutraceuticals, Inc. (Enzyte)
Parker v. Berkeley Premium Nutraceuticals, Inc. (Enzyte) – Goldenberg Schneider filed the first consumer fraud class action on behalf of purchasers of the herbal male enhancement supplement Enzyte and the other products marketed and sold by Berkeley Premium Nutraceuticals, including Avlimil. Berkeley premium nutraceuticals used false and unproven claims to lure men and women into purchasing the supplements, and used deceptive practices to charge consumers for unordered products. The firm successfully certified three nationwide consumer fraud classes and subsequently negotiated a $4.7 million settlement. Importantly, class members retain all rights to recover a portion of the $33 million that was seized from the defendants by the United States Attorney General. Goldenberg Schneider continues its efforts to recover some of the $33 million for the fraud victims.
