State Of Ohio V. Philip Morris (Tobacco)
Members of the firm served as special counsel to the state of Ohio attorney general in the prosecution of the state of Ohio’s Medicaid recoupment action against the tobacco industry. The litigation settled with final approval in 1999. The state of Ohio recovered over $9.86 billion and achieved historic concessions from the tobacco industry regarding youth smoking, advertising restrictions and reformation of industry corporate culture. Factoring in the substantial, if not immeasurable noneconomic components of the settlement, which curb youth smoking and addiction, the settlement proceeds alone are a multiple of 12 times larger than the prior largest Ohio-based settlement.
